The saga of drivers for FedEx Ground and Home Delivery and whether they’re employees or independent contractors has been going on for quite some time, since 2001 in fact. Since the company required the drivers to have certain uniforms, a specific vehicle, assigns the routes, and dictates other policies, the drivers feel they are in fact employees.
Changing their classification from an independent contractor to an employee would make various company benefits available to these individuals. A recent 9th Circuit Court of Appeals ruling came down in the driver’s favor. Other drivers from other states are currently awaiting a decision from the 7th Circuit.
